Repression Against Day Laborers in San Quintín, Baja California

San Quintín, Ensenada, Baja California, February 9th, 2018

Urgent Communique of the Sindicato Independiente Nacional Democrático de Jornaleros Agrícolas (SINDJA)- National Independent Democratic Union of Agricultural Day Laborers

To the day laborers of the country

To all the workers of the country

To the media and public opinion

By this means, the Sindicato Independiente Nacional Democrático de Jornaleros Agrícolas denounces the situation brought about by the agricultural company Dos Californias, located in Punta Colonet.  At this company, on Monday February 5th, the following workers were arbitrarily removed from their positions, hour and work area, along with having their salaries unilaterally reduced.  They worked as drivers and watchmen for the company:

  • Lázaro Chaparro Sánchez
  • Alejandro de Jesús Santos
  • Fernando Timoteo Hernández
  • Benjamín Amador Macías
  • Pablo Antonio Luna Cuevas
  • Apolinar Campos Vásquez
  • Andrés Flores Pedrejo
  • Santiago Ramírez Hernández
  • Daniel Cuevas López
  • Roberto López López
  • Edgar Rafael Ochoa Osuna
  • Mario Ramírez González

The workers afterwards affiliated themselves with the SINDJA union and were supported with legal and labor support so that they could return to their original positions and recuperate their salaries.  On Wednesday the 7th, the first meeting was held between the union and representatives of the company, carried out in the offices of the Secretary of Work, attended by labor authorities.  Afterwards, February 8th, an agreement was signed in good faith between the parties involved so that the workers could return to their work beneath the same conditions they had before.

However, yesterday, February 8th, upon returning to work, they were threatened and beaten inside the workplace at around 9pm by persons identified as Jesús Nuñez (an intermediary transporter of the company), Benjamín and another unidentified person.  The aggressions took place separately in different doors of the company where the workers served as watchmen.

The municipal police were called by 911, but neither a patrol car nor agent ever arrived to intervene.  At 1:00 am, of February 9th, the commander of the Punta Colonet police was reached, but still nobody arrived.  A formal denouncement was submitted to the attorney general of the state, in San Quintín against the abusers, naming them responsible, together with the company, for whatever following act of retaliation might be carried out against the compañeros and their families.

We call on the solidarity of the fellow unions, social organizations, collectives, activists and to all of the people to demand punishment to those responsible and to demand respect for human and labor rights, along with the integrity of the beaten compañeros and their families.  Enough of the impunity and abuse from businessman and their foreman against workers for exercising their rights.  We demand that the labor and judicial authorities enforce the rule of law and apply justice in an urgent manner.

“For a Better Future and a Just Homeland”
